1. About these terms

This website is operated by InCloud Learning Solutions (“InCloud”, “we”, “us”). By using the website, you agree to these terms. If you do not agree, please do not use the website.

2. Information on this website

The website provides general information about InCloud, our capabilities and our solutions. It is not professional, legal, financial or technical advice, and it should not be relied on as such for a specific situation. We take reasonable care to keep the content accurate and current, but we do not guarantee that it is complete, accurate or up to date at all times.

Product screens shown on the website, including APEX-3 screens, use demonstration data. Illustrative diagrams and representative examples describe the kinds of work we do and are not client case studies.

3. Our services

Using the website or submitting an enquiry does not create a client relationship or any obligation on either party. Consulting, learning, change and technology services, and access to InCloud products such as APEX-3, are provided only under separate written agreements, which govern those services.

4. Acceptable use

You agree not to:

  • use the website in a way that is unlawful, harmful or that infringes anyone’s rights;
  • attempt to gain unauthorised access to the website, its servers or related systems, or to interfere with their operation;
  • submit false, misleading or malicious information, or send unsolicited commercial messages, through the enquiry form; or
  • use automated means to scrape or copy the website’s content in bulk.

5. Intellectual property

The website and its content — including text, design, graphics, diagrams, the InCloud name and logos, the APEX-3 name and product screens — are owned by or licensed to InCloud. You may view the website and share links to it. You may not otherwise copy, reproduce, modify, distribute or use its content for commercial purposes without our prior written permission.

6. Third-party names and trademarks

SAP and Oracle are trademarks of their respective owners. References describe the ERP environments in which InCloud works and do not imply ownership, certification or endorsement of InCloud or APEX-3.

7. Links to other websites

Links to third-party websites are provided for convenience. We do not control and are not responsible for the content or practices of those websites.

8. Availability and liability

We aim to keep the website available and secure, but we do not guarantee uninterrupted or error-free access. To the extent permitted by law, InCloud is not liable for any loss or damage arising from your use of, or reliance on, the website or its content. Nothing in these terms limits any right you have, or liability we have, that cannot be limited or excluded by law.

9. Privacy

How we handle personal information, including information submitted through the enquiry form, is explained in our Privacy Notice.

10. Governing law

These terms are governed by the laws of the Republic of South Africa.

11. Changes to these terms

We may update these terms from time to time. The latest version will always be published on this page, with the date it was last updated.
